After 9 years in business, Planet Poker is ceasing real money operations. Management regrets this decision but the impact of the Unlawful Internet Gambling Enforcement Act in the U.S. leaves no reasonable alternative.
During the past several months, Planet Poker explored every reasonable option to continue real money operations. This included working with other cardrooms and ecommerce processors to find solutions to the issues existing in the industry today. Unfortunately, no viable solution was found.
As always, all funds on deposit are safe and secure at Planet Poker.
Real money tables and tournaments will continue at Planet Poker through to 31 March 2007, but effective immediately, players will no longer be able to make a deposit. As an affiliate, players whom you have signed up will continue to earn commission until closure of the real money tables and tournaments on March 31st. The final affiliate payments for March earnings will be posted in the first week of April after which, you will have the same options as the players to either cashout through the normal CASHIER channels, or transfer funds to a participating cardroom.
Players are being advised via email and public announcements in the Cardroom.

NETELLER Takes Positive Step Towards Returning US Customers’ Funds
Wednesday, 21 March 2007 – The NETELLER Plc Group (LSE: NLR), the leading global independent online money transfer business, today announced that it has signed agreements with each of the United States Attorney’s Office for the Southern District of New York (“USAO”) and Navigant Consulting, Inc. (“Navigant”).

The Group is pleased to announce that on 20 March 2007, it signed agreements with the USAO and Navigant which, among other things, outline terms and a timeline under which NETELLER will work toward the orderly distribution of funds to its US customers. Per the agreements, the Group anticipates that within the next 75 days it will announce a plan by which the funds will be distributed to US customers. Navigant will also provide a report to the USAO on the Group’s current financial condition.
“We continue to be committed to returning funds to our US customers and working with the US Attorney’s Office,” said Ron Martin, Group President and CEO. “Progress, while not always visible to the outside observer, has been steady and these agreements mark a milestone in the process.”
NETELLER is continuing to cooperate with the USAO’s investigation, under the advice of its legal advisers and in accordance with court orders in the Isle of Man.

The other day, I posted how Doyle Brunson was kind enough to make some sort of arrangement with Full Tilt Poker, in that there will be a dollar for dollar transfer for US Players. While I respect the fact that he thought of the US Player when this whole thing went down, I cannot help but recall the words he sent to each and every player shortly after UIGEA was enacted.

Shortly after UIGEA was enacted, Doyle Brunson sent out the following email:
Hi this is Doyle Brunson,
I know many of you will be concerned and dismayed about the bill signed into law by the President today.I want to confirm to all existing and potential poker players that it’s business as usual here at Doyle’s Room and we continue to accept players from all over the world including the United States of America.
We at Doyle’s Room have taken extensive legal advice and believe that it is far too early to fully understand the implications of this bill on our industry. Based on the legal advice we have received, the new bill does not make internet poker expressly illegal nor does it take aim at players who enjoy online poker. However, there are some U.S. States that have existing regulations in place that may prohibit online gaming, so we encourage all of our U.S. players to review the laws of the State in which they reside.
Until such time as the law becomes clearer, Doyle’s Room will operate as normal with our full exciting range of games and tournaments at all limits. And finally, please rest assured your money is completely secure at Doyle’s Room.
I personally guarantee it.. "
Doyle makes the following claims in his email:
1. Biz as usual at Doyle's Room.
2. All players worldwide are welcome.
3. They've taken legal advice - based on said advice:
a. UIGEA does not make online gambling illegal for US citizens.
b. Certain states within the US prohibit online gaming.
4. Until the laws become clearer, this will be their posture.
With the sale of Tribecca to playtech, this puts Doyle's Room in a "spot." The network in which his poker room resides is moving to a non-US friendly poker network. This result is that US Players are no longer welcome to play at Doyle's Room. Thus, 1 and 2 above no longer apply.
To the best of my knowledge, three A and B are still relivant. Additionally, the laws in which UIGEA stands for are no more clear than they were the day it was signed into law. In fact, I would argue they're moreso vague than they were on the day of signing.
This seems to be moreso of a business decision to go along with exiting the US Market than a legal one. If in fact it was a legal decision - meaning he takes the posture of "this shit is just not legal, Later Americans..." he'd not have cut a deal with Full Tilt to take dollar for dollar transfer of Doyle's Room accounts belonging to the US Players.
Whatever his motivation, this is one less option for US Players still in the game.
What's next for UIGEA?
What now seems like stock speculation, rumours were circulating that Barney Frank (D-MA), Chair of the House Financial Services committee, was considering proposing a two year amnesty on UIGEA pending further study of the law and its effects. "Sources" who understand how our government operates, however, cite doing such a thing would make entirely too much sense for the government to actually propose and follow through on. For that reason, a two year study will most likely happen when common sense actually becomes something every household and member of government possesses.
Then there's the World Trade Organization... The enactment of UIGEA is not in compliance with the WTO's ruling in favor of Antigua over the protectionist policies of UIGEA. While the US will, in my opinion, dismiss the WTO "as is," things "could" get interesting if the European Union steps up to bat for Antigua. Such a move, however, is not a "high priority" on the EU's agenda. The WTO is expected to render their final ruling in March as to whether or not the US is in violation of trade agreements.
What does all of this mean?
Unfortuantely, I have no clue as to what this all means. I do know it's becoming more and more difficult to fund, play, and remove funds on online poker rooms. While the US Government, some online "money movers," and many poker rooms are posturing as if all of this is definitely unlawful, it still remains unclear whether or not online gambling is or is not illegal for the US player.
What does remain clear, however, is that the squeeze is continuing. Hopefully someone will wake up in position of power with the foresight and common sense to do something about it...

Does UIGEA have a foe in a high place? |
Rumours are circulating that UIGEA may have a foe in somewhat of a high place in Congressman Barney Frank (D-MA). Congressman Frank is the chairman of the House Financial Services Committee and has called for a two-year amnesty on the Unlawful Internet Gambling Enforcement Act, which was attached in shitbag stealth mode by former Senator Bill Frist.

It's reported that Barney would like to repeal UIGEA by offering the amnesty and instead conduct a study to regulate (and surely tax) internet gambling, including online poker.
Back in March 2006, during a discussion of online gambling legallity, he was quoted as saying "'Adults are entitled to do with their money what they want to do."
While I do not wish to create a "My God, the sky is in fact NOT falling" outlook, this does serve as hope. Keep in mind, the sky is falling and will continue to come closer and closer until UIGEA is repealed.

I’ve pretty much ran silent here at the Poker Pub this week. There are several reasons for doing so, I’m sure. I’ve been suspending my opinion on the elections until the smoke clears. My personal life, for starters, is always full of fireworks somehow - no worries, all is well. I snuck away to play live poker this week. I’ve been negotiating with Bugsy’s Club on a poker deal for us… And perhaps I was also just simply taking a breather from posting. All these things combined probably point to the reason why I’ve not really written much in the lines of substantial posts this week.
I have been blog hopping throughout this past week, though. I highly recommend blog hopping. It’s great to read the thoughts, ideas, and stories from others who share your interest. I have my list of “regular blogs” I visit (you can find them on the Poker Pub Blogroll). Feel free to borrow my list, or draw from your own.
The point of telling you this is not to “pimp” any other bloggage, though that is an added bonus, right? No, instead, I’d like to talk about the state of online poker and how it relates to this past election - and throw in some of the thoughts of other Bloggers that I read along the way.
For starters, up until a month or two ago, I thought I was a Republican. I believed that I philosophically aligned with the Republican Party more so than others, considering I (primarily) believe in a strong national defense (funding the military). I believe in less taxes. I believe that while some forms of welfare programs (welfare is a term meaning transfer of wealth or monies from one group or class to another), I do not believe in it so far as to be nearly socialist in nature. I believe those who “work” harder and/or smarter should be allowed to keep most of what they make, and it should give them an edge against others… not that we’re competing here.
In contrast, I’ve always believed that “those other people” (the Democrats) enjoyed transferring wealth from one class to another, were incredibly weak when it came to national defense, defense spending, and/or foreign issues in which involve our military and/or taking a stand. Thus, I believed them to be pansies and socialist. And still, after these elections, I do not believe that any less.
I do, however, believe that I am finding myself lined up with the Republican Party a whole lot less than I once suspected I did. With the introduction of UIGEA, a mostly Republican-supported bill, I’ve become sick to my stomach, as now we have the small matter of the Government telling me how I can and cannot run my business and my personal life. Big brother is alive and well.
It seems to me that we have a case of one group ruling with an iron fist, allowing you to make money, but severely restricting where and how you can spend it. The other party, in my opinion, just wishes to pass my money out to everyone under the sun. (once again, all just my opinion here)…
Historically, I think this country has corrected problems in ever so dramatic over-reactions. Take the tailhook scandal (PBS on tailhook, Wikipedia on tailhook) for example… Our country, and the military specifically were too lenient on matters of sexual harassment. To make things “right” we became so damn tough on them that it almost became a felony to even make eye contact with a member of the opposite sex during normal, routine conversation. It may have been "right" to deal with and take a firm stance on sexual harrassment issues, but there's a difference, IMO, between getting proper laws in place, and going way overboard to make up for past leniency.
In this country, we tend to correct the wrongs of one extreme by swinging to the far opposite extreme. In reality, correcting the wrongs of the far right is not corrected by moving as far left as possible, but instead moving to the center of the bell curve.
The opposite of extreme right is not extreme left, nor is extreme left’s opposite extreme right. It is, instead dead center… Alcanthang cautions us:
"We've merely replaced politicians...
...with politicians. Just as easily corrupted as the mouth breathers now searching for prime consulting jobs.
This isn't the last step in the process, only the first. It needs to be made clear to the new bunch that if/when they fuck up, they are next on the chopping block. I already have the letters ready to go out to my congressmen stating that very fact.
We wanted a change, we got a change, now we must hold them accountable.”
That being said… I highly suggest EVERYONE, democrat, republican, or otherwise, get signed up to get a report of how their congressmen and senators vote. I challenge everyone to do exactly what Al suggests… Let’s all hold our elected officials accountable and show them that we mean business… We’re watching them, we have a vote, and we know how to use it.
My intention was to discuss online poker and some politics, though it seems I've discussed politics with some online poker... Things do not always go as planned...

So, I wake up this morning and receive an email from the GOP. This is not unusual, considering it's nearing election time and they constantly bombard my inbox calling me to action to vote in surveys, donate money, etc. Yea, so today's begging and pleading comes from none other than Sen Bill Frist. I sent a short, sweet "F-U" via email response, but I figure I can lay down a more formal response here at the Poker Pub.

Dear Senator Frist,
I'm writing to you in direct response to your ecampaign email you sent to me via the RNC, asking for money to counter Senators Kennedy and Kerry's contribution to the DNC. The heading of said email says "Our country can't afford a democrat victory." While I am a registered Republican, and typically fall along party lines MOST of the time, I find your selected heading laughable at best.
You see, Bill... Unlike some people... I am coming straight out and telling you that I do not like you at all. I'm not going to cowardly shake your hand, smile, contribute and attach my dislike for you and what "you people" stand for to commentary made under my breath after you've walked away from me. I am a straight forward guy with a clear agenda. I do not like what you stand for and I want you to know it.
When you firmly tell me in your email that "the Democrats are wrong on every issue: From surveillance of international calls coming into our country to securing our borders to keeping the economy strong,"... I think to myself, hell... this guy may be right (no pun intended). But, just because the Democrats on the far left don't have a clue, it doesn't mean you or your far right do either, Bill.
You move on to say that "As the (joke of a) Senate Majority Leader, I've worked closely with the leaders of the Democrat Party, and I can say without a doubt they have repeatedly proven to lack the credibility and ideas needed to lead the United States Congress."
But wait, there's more... You continue on to say "Harry Reid, who would be Senate Majority Leader if the Democrats win -- has called President Bush a "loser" and repeatedly uses obstructionist tactics including the threat of shutting down the Senate in order to (your words, mind you) "screw things up." "
So, Bill, what you're telling me is that every Democrat you've worked with is lacks compitancy? You know, there's a clinical term we normal people associate with that... You know, when you are believing you're the only person who's sane and the rest of the world is just f-ing nuts... You're the one who is insane... It's "insanity." Now say it with me really quick a few times before some Senator attaches a law forbidding anyone, including other politicians from calling any member of our

Though, really, if it were up to you... would there even be a vote? You seemingly know what's best for America, and believe we're incapable of making our own decisions. Thus you place unrelated legislation on the backside of a bill aimed at securing our nation's ports - making it illegal for online gambling.
I am proud to say that I accept your challenge, Bill Frist. I will rise to action on election day. I will get out there and vote early, you know, before the right to vote is taken away from the American People. And while I may not line up with the far left, I sure do not share the same values as you. I'll bring with me all of my friends and family who you deceived with the passing of the UIGEA act, piggybacked on the SAFE Port Act. And along with them, I'll bring the people you put out of work by affecting online poker playing. And with them, we'll bring the people who could have benefitted from the extra tax revenue we could have obtained by regulating the industry as opposed to trying to alienate it.
And finally, Bill, I hope that each and every one of your partners, you know, the ones who wish to shove their moral values right down the throat of our people get voted out of office, and I'll do all I can to help that occur... By the way, this is the very same practice that we as a country condemn when other countries governments try to "force" their beliefs onto that of their citizens. And Bill, did you bother to tell anyone your dirty little secret? Did you mention that thanks to you, the work of Jack Abramoff lives on? Did you tell the people that his bill and the UIGEA that YOU sponsored and all your buddies supported are in fact nearly one in the same?

Email I received from Pokerroom regarding their position on the UIGEA act. Email reads as follows (my notes, if any, in italics):
U.S. Restrictions
Hi BeerGawd --- yes, even pokerroom is smart enough to correctly identify me as the God of Beer, patron saint to all things Pub.
On September 30th 2006 the U.S. Congress passed the SAFE Port Act which also contained certain provisions known as the Unlawful Internet Gambling Enforcement Act of 2006 that affects the processing of payments between U.S. customers and online gaming companies. The legislation was signed into law by President George W Bush on October 13th 2006.
We regret that the U.S. has taken this step to make it virtually impossible to offer real money entertainment to U.S. customers. It is doubtful that the U.S. authorities will achieve their stated goals by introducing such legislation. We believe that a properly monitored forward-looking regulation would be much more effective than this general ban.
Entirely due to this new law, we are disappointed to announce the following restrictions for all customers within the U.S.:
Depositing Restrictions
As officially stated before, we have been working on a technical solution to restrict all customers within the U.S. from depositing new funds at PokerRoom.com. This solution will be implemented on October 25th.
Real Money Restrictions
We will have implemented the technical solution to restrict all customers within the U.S. from accessing our real money games starting Monday, November 6th. After that time you will still be able to login to PokerRoom.com, enjoy all of our play money games and withdraw funds from your account at your convenience.
Cash-Outs
Your funds will continue to be safe, secure and yours, and will be transferred to you at your request. The option to cash-out will remain available to you.
Unused Tournament Tickets
Valid tournament tickets are as good as cash and will be refunded to your account once the U.S. restrictions are implemented on November 6th. It may take some days for all tickets to be processed into cash, and only valid tickets (not expired) at the time of the U.S. restriction will be refunded.
Player Points / Loyalty Points
Player points and loyalty points will be inaccessible to all U.S. customers once the changes go live; but this does not mean that your points will expire. Your hard earned points will be stored indefinitely, in the event of real money play becoming available again. Until the U.S. restrictions are in place on November 6th you are free to use your points in our loyalty program.
Pending Bonuses
Pending bonus tasks will be void after the U.S. restrictions come into effect on November 6th, as it will not be possible to collect player points via our real money games. Until the Real Money restriction is in place you can continue to collect points to clear bonuses in your account.
At PokerRoom.com, we are of course very sorry for this development and we hope that we get the chance to meet all our U.S. players again in Real Money games, as we are aiming to offer real money games as soon as the legislation allows us to. We will do our utmost to continuously keep you up to date with future developments.

Party gaming took a 250 million one time charge to write down closing its US Operarions after the UIGEA was signed into law. Despite this one time charge, Party CEO Mitch Garber suspects there's significant opportunity for consolidation and expansion within the industry.
Additionally, their group revenue from non-US operations were up 158% on the quarter and additionally Party's non-US poker net daily revenue up 151%.

Complete story here. Neteller has confirmed it will comply with the US Gambling Legislation. They stopped short of saying they're not servicing US customers for gambling related transactions, though they did express that how they interact with the US Marketplace going forward will be determined when the Federal Reserve Board and the secretary of the treasury confirm the regulations that are issued and to be followed.
To quote neteller says they will "…comply with the Act and its related regulations as if it were subject to the Act's jurisdiction. This action is intended to ensure that the Company is able to continue to operate with the support of its principal commercial partners and to protect its shareholders, business partners, employees and reputation."

Looks like mansion poker is here to stay, but the sportsbook and casino is on its way out...
Effective 16 October, 2006, MANSION suspended access to our Sportsbook and Casino gaming services for Members located in the United States .
What does this mean to you as an Affiliate?
When you refer a US based Member to MANSION, the Member will have full access to our Poker and Exchange products, but will be restricted from accessing our Casino and Sportsbook. As a result, US based referred Members will no longer trigger Affiliate bounties for Casino and Sportsbook play, and will not earn their Affiliates commissions on these two products. You will still earn applicable acquisition bounties based upon referring US based Members who use our Exchange or Poker.
Non-US based referred Members shall remain unaffected. As such, your earning potential on non-US players remains unchanged.
What about US based members you have already referred?
If you referred a US-based MANSION Casino or Sportsbook player before 16 October, 2006 you remain eligible for any triggered bounties or commissions earned prior to this date. After 16 October, 2006, these Members will be restricted from accessing MANSION Casino and Sportsbook, and will therefore no longer earn their affiliates commissions for activity on these products.
You remain eligible for applicable bounties and commissions on their Poker and Sports Exchange activity.
What should you do today?

Much discussion has been floating around the net as to whether it is now legal or illegal to play poker online for American Players. Whether it's news articles, players blogging, or forum chatter, it seems that everyone is either looking for answers or handing them out.
I can't tell you for certain whether or not it is legal. I am not a law expert. I'm not a lawyer, nor am I a legal analyst of any sort. I'm just a poker playa with a blogging problem.
I can, however, tell you this. I have an opinion on the matter. It's of my opinion that there is a law on the book, affectionately referred to as the UIGEA. I can tell you it is aiming towards us online gambling types and the casinos, sportsbooks, and poker rooms. I can tell you that the law aims specifically to pressure money transfers to and from our banks and credit cards.
I can tell you that this law is trying to squeeze us. I cannot, however, tell you whether or not playing poker online is legal or illegal.
I personally believe the law to be unconstitutional in many aspects. I believe this issue of gambling to be a state, not a federal issue. I believe we'll continue to hold tournaments for as long as we're able to. I believe that this legislation is open to interpretation. I believe poker rooms such as party are correct in their interpretations. I also believe rooms such as poker.com and pokerstars are correct in theirs.
I believe that everyone has a right to an opinion and to also state their opinion on the matter, whether it's that it is or is not legal...
I welcome the opinions and personal interpretations here at the Poker Pub at any time... even if it does not agree with what I believe.

Action by Ongame that affects Touchstone Gaming Players
Touchstone Gaming currently povides poker throught The Ongame Network, owned by bwin.
To the best of our understanding, bwin will block poker service to new players with U.S. addresses, but will allow existing players to continue using their poker network.
How this affects you today
To the best of our knowledge, customers which signed up on or before October 15th can either continue playing within their Touchtone Poker account or transfer their poker chips back to their Touchstone Gaming cashier account.
Because players that signed up on or before October 15th can still play poker in their Touchstone Poker account, we are planning to go forward with our regularly scheduled $200 Player Love Freeroll this Sunday, Oct. 22, at 8:00 PM EST, as well as our previously scheduled $100 Euro Player Love on Sunday, Oct. 22, at 5:00 PM EST / 10:00 London Time.
If you signed up with Touchstone Gaming on or before October 15th, you should have a free ticket to these events.
What we intend to do
Touchstone Gaming, however, is committed to providing its poker services to all of its existing players and to any new customers in the U.S. and around the world where legally allowed.
As a result of Ongame?s announcement, Touchstone Gaming is re-evaluating its options with the intention of finding an acceptable poker network for all our customers.
Meanwhile, Touchstone Casino is available to all US customers where legally allowed, as both we and our casino provider are privately owned companies and not publicly traded. There should be no interruption involving our Casino services.

We regret the inconvenience that the current situation has created. As our options are clarified and we define a workable strategy for providing the best service to our well loved players, we will share that information with you.
